Man gets 38 years for fatal Colo. Springs love triangle shooting

COLORADO SPRINGS, Colo. - A 41-year-old Colorado Springs man convicted of killing his ex-girlfriend's husband has been sentenced to 38 years in prison.

The Gazette reports District Judge Timothy J. Schutz sentenced Roy Saldivar on Friday for the Sept. 22, 2011, shooting death of 34-year-old Oscar "James" Frias, of Thornton, outside a Colorado Springs ice cream shop. Saldivar was convicted in July of second-degree murder after, acting as his own attorney, he fended off a more serious charge of first-degree murder.

Frias was shot three times outside a Dairy Queen.

On Friday, Schutz criticized Saldivar for his "cavalier attitude" about taking another man's life, saying "you could have gone anywhere to avoid the confrontation. You chose to stay around."
