Lawyer for ex-sheriff says misconduct indictment is flawed

COLORADO SPRINGS, Colo. -- An attorney for former El Paso County Sheriff Terry Maketa says an indictment accusing the ex-officer of extortion, official misconduct and other crimes is fatally flawed.

The Colorado Springs Gazette reports Maketa's lawyer made the comments Tuesday during a hearing mostly devoted to setting deadlines for motions.

Maketa, former Undersheriff Paula Presley and former Sheriff's Commander Juan San Agustin were indicted in May on charges including false imprisonment and kidnapping as well as extortion and misconduct.

Their attorneys say they plan to challenge the way a grand jury was conducted when it returned the indictments as well as question whether the evidence is sufficient.

The judge gave defense attorneys until Oct. 3 to file motions challenging the charges. Prosecutors have until Oct. 14 to respond.
