Colorado appeals court orders resentencing in marijuana case

GRAND JUNCTION, Colo. (AP) — The Colorado Court of Appeals has ordered a lower court to resentence a woman who appealed part of her conviction for marijuana distribution.

The Daily Sentinel reports Krystal Dawn Britton was found guilty by a Mesa County jury of possessing marijuana with intent to distribute and possessing drug paraphernalia.

Authorities say Britton also faced a special offender count that elevated possessing with intent to distribute from a level 3 felony to a level 1 felony, which she appealed.

The appeals court says the jury did not find her guilty of all elements of the special offender charge.

The court ruling will require Britton to be resentenced in line with the lesser, level 3 charge of possession with intent to distribute marijuana.
