DENVER — The Denver medical examiner released the name of the man shot and killed by a homeowner.
Rickie Casias, 36, was identified Monday as the man police found unresponsive in the basement of a home near the northwest corner of 14th Avenue and Downing Street Friday night.
Police say Casias was shot by the owner of the home he was allegedly burglarizing. The homeowner told police Casias was shot when he refused to leave the property.
Denver policewere called to that home around 8 p.m. Friday. When officers arrived, they checked the entire house and the yard outside.
Officers found Casias in the home’s basement "unresponsive," and was pronounced dead a short time later.
Police say the homeowner is cooperating with investigators, "and that no charges are pending at this time."
It’s not clear if the shooting falls under Colorado’s “Make My Day” law, which grants immunity to people who kill a home intruder if they fear they are in danger.
A law enforcement source told Denver7 that the law might apply, “but it will be up to the district attorney to decide."
