DENVER – A 27-year-old man faces investigation on a first-degree murder charge after he allegedly shot and killed a man who was arguing with his roommate.

The shooting happened just before 2:45 p.m. Monday near E. 35th Ave. and Krameria Street in Park Hill. According to an affidavit for his arrest, 27-year-old Justin Mack had shot the victim, who has not been identified, in the head.

The affidavit says the victim and a woman with whom he was living had been in an argument that morning, and that the woman and Mack had gone back to the home to grab some of her things.

The woman told police she’d asked dispatchers to have police officers stand by as she went and got the items. But as she and Mack waited, according to the affidavit, the eventual victim of the shooting drove up. He and the woman argued before she got back into Mack’s vehicle, according to the affidavit.

But after doing so, she told police that the man tried to grab her out of Mack’s vehicle as they drove off, at which time she heard a gunshot and saw the victim fall off the car with a wound to his forehead, the affidavit says. It also says that she told police that Mack had a gun.

The affidavit says that Mack called dispatch to report the shooting when it happened and stayed at the scene. The victim died after being transported to Denver Health.

Mack is scheduled to make his first court appearance Tuesday, according to court records.
