LARIMER COUNTY, Colo. - A man accused of shooting his girlfriend in the head will appear in court for a preliminary hearing on Monday, Jan. 28.

Raphael Gentry Ogaz-Montoya, 25, allegedly shot his girlfriend, Sarah Harris, 24, in the head with a .45-caliber handgun at the Larimer County home they shared with his father and stepmother in October. Harris survived.

Ogaz-Montoya will appear for a preliminary hearing on charges of first degree assault and prohibitive use of a weapon Monday at 2:00 p.m.

The suspect appeared in Larimer District Court on Dec. 17. Ogaz-Montoya’s lawyer, Don Lozow, said in court that the shooting was an accident.

The accused man was advised that his assault and domestic violence charges have been amended  to first-degree assault and prohibitive use of a weapon. Initial charges were increased after Harris’ roller derby team lobbied for tougher charges.
