FORT COLLINS, Colo. - A retrial for an Occupy Wall Street sympathizer accused of setting a fire that burned a building under construction in Fort Collins and spread to a residential complex is now set for September.
Benjamin David Gilmore's first trial on charges including arson ended last September with a hung jury.
The Coloradoan reports his second trial initially was to start in February, but after a court hearing, it is now set to begin Sept. 16.
The 2011 fire caused an estimated $10 million in damage. It started in a four-story apartment complex under construction and spread to the occupied Penny Flats condominium and retail building next door.
Gilmore has maintained his innocence.
His brother told reporters that Gilmore's defense costs have approached $100,000.
