Colo. Affirmative Action Ban Losing In Tight Race
Amendment 46 Still Too Close To Call

DENVER -- Colorado voters are just about split on whether to ban state affirmative action programs. With 87 percent of the projected vote counted, the measure was trailing by just 13,479 votes, out of nearly 2 million votes cast. Voters in Nebraska passed a similar measure on Tuesday.
Both measures are backed by Ward Connerly, a former University of California regent who has helped pass similar proposals in California, Michigan and Washington State. Connerly points to Sen. Barack Obama's candidacy as proof that preferences based on race or gender are no longer needed. The measure says that the state may not discriminate against or grant preferential treatment to individuals or groups based on race, color, sex, ethnicity or national origin.
