A Craig doctor convicted of unlawfully prescribing controlled substances that led to the death of a patient has been acquitted of the most severe charge against him because of a missing word in a charging document.
The Craig Daily Press reports that Joel Miller was found guilty in November 2015 of several charges related to overprescribing controlled substances while he worked in Craig from 2008 to 2010.
He would have been the first Colorado doctor to receive a prison sentence for causing the death of a patient, but a federal judge granted a motion for acquittal on that charge because the word fentanyl was missing in the charging document.
Miller's other five convictions still stand.
He now faces a maximum sentence of up to 10 years in prison.
