COLORADO SPRINGS, Colo. -- The trial for a Colorado Springs homeowner accused of fatally shooting an intruder has been set for next year.
The Gazette reports that Michael Joseph Galvin pleaded not guilty to negligent homicide in connection with the November 2015 death of Robert Carrigan. He has been released on bond and is scheduled to face trial Jan. 9.
An El Paso County grand jury indicted Galvin on the charge in April, finding that he failed to provide adequate warning before firing at least one bullet in Carrigan's back.
The victim was shot in Galvin's detached garage.
Galvin's attorney says she plans to argue the case using the state's "make my day" law, which offers protections to people who defend themselves from intruders inside their homes.
