Boulder City Council gives first approval to Pearl Street Mall smoking ban

BOULDER, Colo. - The Boulder City Council gave initial approval to a proposal to ban smoking on the Pearl Street Mall Tuesday, but one council member is worried the punishment for smoking is too severe.
The ordinance would call for a fine of up to $1,000 or up to 90 days in jail for first offenders.
Councilwoman K.C. Becker said she supports the ban, but thinks jail time for smoking is too harsh, reported the Daily Camera.
She would prefer a $500 fine for the first two offenses and jail time and/or higher fines for third offenses, the newspaper reported.
The council approved two versions of the smoking ban, one with the high fine and jail time and another without, that way they can debate the fines in a second reading.
