Police arrest third suspect in deadly shooting outside Denver 7-Eleven

DENVER – Police have arrested a third suspect in the deadly shooting of a man outside a Denver 7-Eleven store.

Police said Friday that Ru Shawn Bykei Wharton, 41, was arrested Thursday night. He was wanted on a charge of first-degree murder.

David Houston, 25, and an unnamed juvenile were taken into custody on Monday. Police continue to search for a fourth suspect who has not been identified.

According to a probable cause affidavit obtained by Denver7, surveillance video shows Houston and two other men inside the 7-Eleven store at Colfax Avenue and Pearl Street minutes before Justin Slyter, 39, was shot and killed early Sunday.

The men exited the store, saw Slyter engaged in an altercation with an apparent panhandler, now identified as Wharton, and joined in on the fight while one of the men stole his wallet, the affidavit states.

When Slyter confronted the men as they tried to drive away, he was shot once by someone inside the vehicle and the suspects took off eastbound on Colfax, police said in the affidavit.

A GoFundMe account set up in Slyter’s honor had raised about $40,000 toward its $50,000 goal as of Friday afternoon.
