DENVER - A federal judge has dismissed negligence claims in lawsuits brought by survivors of the Aurora theater shooting, while allowing wrongful death claims to go forward.
U.S. District Judge R. Brooke Jackson issued the order dismissing parts of 10 separate victims' lawsuits in Denver federal court on Wednesday. Defendant Cinemark, owner of the theater, had sought dismissal of the lawsuits.
The July 20 shooting killed 12 people and wounded 58 others.
Survivors and their families say lax security at the Century Aurora 16 made the theater vulnerable to the shooting rampage by defendant James Holmes.
