Friends of slain Colo. theater victim sue Cinemark

Two people who saw their friend die in the Colorado theater shooting last summer have filed a negligence lawsuit against the theater owner.

Chichi and Derick Spruel join others who have filed lawsuits accusing Cinemark of having inadequate security for a midnight showing of "The Dark Knight Rises" on July 20, when a gunman killed 12 people and injured 70 others.

The Denver Post reports the couple's lawsuit, filed this week in federal court in Denver, says the Spruels had gone to the theater with Jesse Childress, who was fatally shot and fell into Derick Spruel's arms. The suit says Spruel's wife, Chichi, was among those who called 911. The lawsuit says both have suffered psychological injuries.

Cinemark has said it couldn't have foreseen the attack.

During the shooting investigation, it was revealed the rear door to the theater that the gunman used did not have a working alarm.
