El Jebel restaurant owner Fredy Cabrera pleads not guilty to murder charge

GLENWOOD SPRINGS, Colo. - An El Jebel restaurant owner has pleaded not guilty to first-degree murder in the July shooting death of a man his stepdaughter was living with.

The Glenwood Springs Post Independent reports Fredy Cabrera entered his plea Thursday. The judge scheduled a three-week jury trial to start Sept. 22.

Cabrera is charged in the death of 21-year-old Douglas Menjivar outside the apartment where Menjivar and Cabrera's stepdaughter were living.

The stepdaughter, 18-year-old Leydy Trejo, was wounded in the leg. Cabrera is charged with first-degree assault in connection with her injury.

Cabrera's attorneys have challenged the first-degree murder charge, saying there's no evidence Cabrera planned to kill Menjivar and the two apparently struggled before the shooting.

Prosecutors contend Cabrera shot the two because he was angry about their relationship.
