Aurora theater shooting case gets new DA to decide on death penalty

The prosecution of the Aurora theater mass shooting case gets a new district attorney in January.
A former military prosecutor will take control of the case against the man accused of carrying out the shooting.
Republican George Brauchler defeated Democrat Ethan Feldman by about 6 percentage points Tuesday to become the new district attorney for the 18th Judicial District. He will replace Carol Chambers, who oversaw the filing of charges against theater shooting suspect James Holmes.
Brauchler will decide whether to seek the death penalty against Holmes, who is charged with crimes including murder in the attack July 20 that killed 12 people and injured at least 58 in Aurora.
The Denver Post reports that since Brauchler hasn't had access to Holmes' case file until now, he hasn't said whether he believes death is appropriate in the case.
