Denver officer, security guard cleared in shooting

DENVER -- Denver's district attorney won't bring charges against a police officer and a security guard who shot and wounded two brothers after one of them allegedly opened fire near a downtown Denver nightclub.

The Denver Post reports that District Attorney Mitch Morrissey issued a letter to Denver's police chief saying the actions of Det. Randall Wagner and security guard Edwin Montoya likely prevented others from being harmed in the July shooting.

Morrissey says brothers Kevin Lee Jones and Robert Jones had been involved in a fight and that Montoya used pepper spray to break it up.

The security guard got help from Wagner, who had been working at the nearby Epernay Lounge, when authorities say Kevin Jones began firing into a crowded street.

Wagner and Montoya returned fire, striking the man and his brother, who was unarmed.

Kevin Jones faces attempted murder and assault charges.
