Shooting suspect in road rage murder charged by Denver District Attorney

DENVER -- A suspect in a road rage incident in southwest Denver has been charged after allegedly shooting and killing a driver who had flipped him off.

David Alberto Garcia, 28, was charged with first-degree murder in the death of Miguel Baray, 28. The shooting took place in the area of the 3100 block of Kentucky Avenue.

Garcia was in a stolen Audi behind Baray, who had made a stop at a stop sign in the area of Kentucky Avenue and Irving Street on Nov. 26. Garcia told police that Baray took too long at the sign so he honked at Baray. The victim then flipped Garcia off, at which time Garcia accelerated and pulled up along Baray and shot him with a .45 caliber handgun, according to a police report.

Detectives were already closing in on Garcia after a Thanksgiving day shooting that left Luis Zamora-Ornelas, 20, dead. The injured victim reportedly crawled to a neighbor’s front porch to ask for help in the area of East 43rd Avenue and Fillmore Street. A motive in that shooting was not released.

Garcia remains in custody in the Denver Detention Center. His next court date has not yet been set.
