Boulder Police: Councilman Caught Driving With Pot

Police Find Pipe, 2.1 Grams Of Pot

A Boulder city councilman was arrested Monday night after he was allegedly caught with 2.1 grams of marijuana, Boulder police said.

Erwin "Richard" Polk was arrested for suspicion of driving under the influence of drugs after he was pulled over for driving violations near the intersection of 15th and Pearl Street, police said.

The officer who pulled Polk over said he smelled a strong odor of marijuana smoke coming from the car and Polk. Police said they searched Polk and the car and found a wooden pipe and 2.1 grams of what they believe is marijuana.

Polk told police he had one glass of wine prior to being pulled over, police said.

Polk was cited with driving under the influence of drugs and for failing to present evidence of insurance. Police said Polk was cooperative with the officers and he was later released from jail.

The city's charter states that should a council member be convicted of a crime or a felony while in office, his or her position will remain vacant.
