Ramsey Detective Fights Possible Contempt Of Court
Judge Must Decide If Steve Thomas Was Legally Served With Subpoena
BOULDER, Colo. -- It's a question of who to believe.
A process server testified Monday that he chased former Boulder police detective Steve Thomas into his home while trying to serve him with a subpoena.
But Thomas testified that he wasn't even home when the process server, Larry Mahoney, said that he was.
Jefferson County District Judge Jane Tidball must decide who's telling the truth.
Tidball issued a warrant for Thomas' arrest after he failed to appear for testimony last month in the criminal trial of Thomas Miller, who was later found not guilty on charges of trying to sell the ransom note in the JonBenet Ramsey murder case.
But will have to decide if Thomas was ever subpoenaed. If he was, he could be cited with contempt of court.
But Thomas claims that Mahoney is lying. Lawyer Robert Ransome, representing Mahoney, suggested that Thomas didn't want to be subpoenaed because he didn't want to be questioned in the Miller trial about whether he had leaked the Ramsey ransom note to the news media.
Such testimony could hurt Thomas' case in the $65 million defamation lawsuit the Ramseys have filed against him, Ransome said.
Mahoney testified that Thomas was doing yard work when he pulled up to his house to serve the subpoena. He said that Thomas ran into the house and refused to answer the door.
Mahoney said that he left the subpoena on the front door, but Thomas testified that he was not home at the time that Mahoney claims to have served the subpoena.
Ransome still had witnesses to present when the hearing ended Monday, with Thomas' lawyer, Dan Caplis, yet to present the former detective's case.
Monday's hearing was continued July 31.
