ACLU To Defend Student Suspended For MySpace Postings

Two Little High School Students Suspended For Comments On Web Site

The American Civil Liberties Union said it will defend a student suspended by Littleton High School for mocking comments made at the MySpace.com Web site.

"It's definitely a First Amendment issue. School kids do have the right of expression. When it's on campus, the school has some ability to regulate what students write, but this is off campus."said Mark Silverstein, legal director for the Colorado ACLU.

About a dozen students held a rally Friday afternoon in support of Bryan Lopez, a 16-year-old junior. He was suspended for 15 days.

"I just wrote stuff about the school to make people laugh," said Lopez from his home Friday. "They were stereotypes about the school, what people say about the school. It was an opinion, not facts."

Although no names were used, it was possible to identify people from their descriptions.

A parent brought a printout of the list to school a week ago, and Lopez was suspended the same day.

Littleton Public Schools spokeswoman Diane Leiker confirmed the suspension was for Internet postings.

"A writing that disrupted the educational process at school occurred in this venue ... Just like when any other student behavior disrupts the educational process, it is the school's responsibility to respond accordingly."

Ryan Reger, a friend of Lopez, said the school took the postings too seriously.

"When you're at home and you're on your computer -- people say things every day," the 18-year-old said. "I don't know why they're taking it out on Bryan. It's just so blown out of proportion."

LHS Senior Auburn Kisselman had responded to the Lopez's posting, which didn't think was offensive.

'Brian wrote a bulletin that said, 'You know you go to LHS when ... the girls at your school are not hot... the ones that are wear two pounds of makeup, which makes them fake' ... just very general types of things," said Kisselman.

She said she was suspended for one day for responding to his comments.
