Josiah Fay To Be Adopted By Victim's Brother, Wife

A premature infant born in Hawaii will head for Denver Tuesday after he was delivered from his brain-dead mother.

Police said that Sarah Fay, 34, was beaten by her boyfriend on Nov. 25, and kept on life support until Josiah Fay could be delivered by caesarian section three weeks after the attack. She was removed from life support after the delivery and her kidneys and liver were donated.

The boyfriend, Marwan Jackson, 25, has been charged in the murder of Sarah Fay. Other charges include sexual assault, kidnapping, robbery and violation of a protective order

Josiah Fay was adopted by relatives who live in Denver and they were waiting until he had gained enough weight to be brought back to Colorado. He now weighs 5½ pounds.

Sarah's brother, Michael, and his wife, Carrie, have started the legal process to raise Josiah as their own.

"We're encouraged by his progress and eager to bring him home to our family," said Michael Fay,

Carrie said that Josiah had to learn how to breathe and swallow.

"He had a hard time figuring all that out, that he had to do that all at the same time and he's getting pretty good now," said Fay.

Sarah's family set up the Sarah Marie Fay Memorial Fund to help support her three children. Those who would like to make a contribution can go to www.sarahmariefay.com.

"There's always times where I'm thinking about Sarah, looking at her picture and it's pretty upsetting," said Michael.
