Lawsuit Over Pit Bull Ban Back In Court
Suit Says Breed-Specific Ban Is Unconstitutional

AURORA, Colo. -- A lawsuit against the city of Aurora over its new pit bull ban has been reinstated.The judge had dismissed the suit but that was before he learned some important paper work had apparently been misplaced.Brighton resident Tina Villani filed the lawsuit on Nov. 3 asking the 18th Judicial District Court to overturn the ban and compensate pit bull owners who've paid the annual $200 licensing fee or who had their dogs confiscated.
District Court Judge Michael Spear mistakenly dismissed the lawsuit on Dec. 20 because the court wasn't aware Villani had filed a response in a timely manner to the city's earlier motion to dismiss. He reinstated it earlier this week.Villani said she hopes a trial date will be set soon.Aurora City Attorney Charlie Richardson said officials are confident the ordinance will be upheld.Starting Feb. 1 no new pit bulls will be allowed in city limits and current owners will need to pay a licensing fee, get liability insurance and spay or neuter their pets.
