A former Air Force Academy cadet will go to trial for an alleged sex assault on a female cadet in 1999.Lt. Joseph Harding asked for a trial in the indecent assault case and his request was granted by a military criminal appeals judge. Harding wants to clear his name and wanted the case to go to trial after it was put on hold by a lower court, said Harding's lawyer, David P. Sheldon. The case is expected to go to trial in October. The maximum sentence Harding faces if convicted on the indecent assault charge is dismissal from the Air Force and five years in prison at Leavenworth, Kan.
In the meantime, Harding will not face a rape trial in the case involving Cadet Jessica Brakey. Brakey's case was dropped after therapist Jennifer Bier refused to turn over her counseling records.
