Child Abuse Charge Dismissed Against Denver Cop
District Attorney Says Misunderstanding Occurred In Park Meadows Restaurant

LONE TREE, Colo. -- Child abuse charges have been dismissed against Denver police officer and his wife in a case involving their baby.The 18th Judicial District Attorney's Office said it determined "a misunderstanding occurred" in announcing dismissal of the charges against Jeremy and Amy Olive.While at a restaurant, a concerned citizen was under the impression that the couple had given alcohol to their baby, the District Attorney's Office said in a statement.
"After a review of additional witness statements, it appears that the child was given water and not alcohol," the statement said.Lone Tree police officers were called to the Fish City Grill at Park Meadows mall on the night of Aug. 22, 2011, on a child abuse/neglect report.At the restaurant, a woman diner who had called 911 told officers the parents appeared to be "pretty drunk," according to a police report."When the baby got fussy," the witness said she saw the parents "take their straw, put it into the margarita glass, cap their finger over the end to catch some of the drink, and then release the drink into their baby's mouth," the police report stated."She also saw them let the baby take the empty glass and poor (sic) whatever liquid that was left into her own mouth," the report said. The couple was letting the child crawl around, eating food off the floor.The witness said she was also concerned because, at one point, Jeremy Olive said, "I'm a cop, it's OK," according to the report. He was off-duty at the time.The woman who called 911 told police said she followed the couple as they left the restaurant pushing a stroller.The woman said she saw the parents "stumbling and pushing their stroller into the street as a car was approaching. They had to quickly pull the stroller back because they almost got hit a by a car," according to the police report.The witness directed police to a Ben & Jerry's Ice Cream stand in the mall, where the officers caught up with the couple and their child. Officers questioned the couple as they entered the mall parking lot."Jeremy and Amy's eyes were both bloodshot and watery and their speech was slurred," the police report said.Police said Jeremy Olive was argumentative with officers, initially refusing to give his identification or age, according to the police report. Jeremy Olive repeatedly asked officers, "Are we under arrest?" and "Are we free to leave?" the report said.Police said Jeremy Oliver also refused an officer's request to step from the parking lot into a food court, because the couple and officers were blocking people trying to get into their cars.An officer finally handcuffed Jeremy Oliver, and he was placed in a patrol car, the report said.As her husband was handcuffed, Amy Olive told police, "No, no, you don't have to do this. Let me talk to him," the police report said.The wife tried to explain to a male officer that Jeremy Olive was acting like this because of his ego and, "as a guy, (the officer) should know what he's going through. …Ya (sic) know, it's just a guy thing," the police report said.Amy Olive called someone on her cellphone and told the arresting officer it was Jeremy Olive's Denver police supervisor."Please talk to his sergeant, please," the wife urged the officer, according to the police report.The Lone Tree officer took the cellphone and talked with a man who identified himself as "Bobby," a Denver Police Department sergeant who was a former supervisor of Jeremy Olive, the report said.Bobby asked the Lone Tree officer what was going on, and the officer said that "Jeremy was under arrest, we were arranging to get them a ride home and they would be released on summonses," according to the police said. "Bobby asked if he could talk to Jeremy, and (the Lone Tree officer) held the phone to Jeremy's ear as he sat in the back of the patrol car."Police said the toddler did not appear to be intoxicated or injured and did not require medical attention.Police said they issued summonses to the couple, took their photographs and let a neighbor come to give them a ride home.Amy Olive asked an officer if he could get Jeremy Olive's handgun from the center console of the couple's car, because she didn't want to leave it in the parked car, the report said. The officer retrieved the holstered revolver and secured it in Amy Olive's purse in the rear cargo area of the neighbor's sport utility vehicle.Jeremy Olive denied telling anyone he was a police officer at the restaurant, the report said.
