Shooting of Man Simulating Weapon Justified, DA Says

FORT COLLINS, Colo. -- Two police officers involved in the shooting of a domestic violence suspect acted appropriately and will not be charged, the district attorney said.Bill Evans was wounded in his home on Jan. 7 after Evans said he was armed and threatened to kill officer Brian Ivers and officer Karen Spaulding, police said.The two Fort Collins Police officers identified themselves and Evans shouted at them to get back. He told the officers that he had a gun and would kill them, police spokeswoman Rita Davis said. The man told his girlfriend to get down and "moved towards the officers simulating actions of loading a gun and held his hands up as if he was taking aim at the officers," Davis said.
Ivers fired one shot at the suspect from outside the window but missed the suspect.Evans then told officers that he was reloading his gun and reiterated he was going to kill them, Davis said.Spaulding then fired two rounds and Ivers fired another shot as the suspect approached them, pretending to point a gun at them, Davis said.The suspect was hit once in the abdomen. The officers then determined that Evans did not have a weapon.Ivers and Spaulding were not hurt during the confrontation. Evans' girlfriend was treated for a head wound received during the alleged assault and released, Davis said.The officers went to the home after someone called 911 to report a domestic disturbance.District Attorney Stu VanMeveren said Wednesday the officers acted within the law in shooting the suspect.
