No Charges In Police Wounding Of Bystander

DA: Incident 'Unintended, Very Unfortunate'

POSTED: 4:02 pm MDT July 27, 2010

No charges will be filed against Denver police officers involved in a shootout outside a fast-food restaurant parking lot that wounded a bystander.

Denver District Attorney Mitch Morrissey says the two officers were justified in firing their service weapons at Sorl Shead, who police say fired at least four shots from a 9 mm handgun at about 2 a.m. on July 2.

Bullet fragments from the police officer's weapon struck a woman on both her legs and her lower torso as she walked through the restaurant's parking lot and then took cover. Her injuries were described as non-life threatening.

None of the bullets police fired at Shead hit him.

In his decision letter, Morrissey called the woman's wounding "unintended and very unfortunate."

The officers were originally called the Vinyl nightclub after a fight was observed outside the establishment by a High Activity Location Observation surveillance camera around 2 a.m. While police were investigating the fight, gunshots were heard in the Arby's parking lot across the street.
