Deal May Be In Works In Kobe Case

Reports Claim Possible $5M Deal Between Bryant, Accuser

POSTED: 3:58 pm MDT August 22, 2003

There were reports Friday of a possible deal between Kobe Bryant and the woman who accused him of sexual assault.

While there are only allegations at this point, one legal expert said a deal between the two sides is a possibility.

The Kobe Bryant rape case is a criminal matter, but if a multi-million dollar deal was reached behind the scenes on a civil level, it could affect the criminal trial, 7NEWS reported Friday.

"It would not surprise me if plea negotiations were going on," said Craig Silverman, 7NEWS legal analyst. He said 90 percent of criminal cases in Colorado are settled by plea bargain and it could happen with Bryant.

"It could well be that Kobe's accuser has said to her personal lawyer, 'Look, make this thing go away. I feel like I'm entitled to some money damages. I don't want to testify at a criminal trial.'"

Some media outlets are reporting a possible deal where Bryant would offer the victim $5 million compensation on a civil level for pain and suffering. It's then possible, the victim might decide to forgo testifying in a brutal, high profile criminal trial, according to 7NEWS.

Silverman said the district attorney would have to approve such a deal, but he added that would likely spark public outcry, and set a dangerous precedent.

"If (the District Attorney) allows Kobe to plead to a non sex assault misdemeanor, every Colorado defense attorney will ask every Colorado prosecutor, 'May I have a Kobe Bryant special please?' "

The preliminary hearing for Bryant has been set for Oct. 9.
