Colo. Could Punish Eye Surgeon Guilty In Nev. Malpractice
State Medical Board Will Wait For Public Findings In July, Despite 7NEWS Information

ENGLEWOOD -- An Englewood eye surgeon found guilty of medical malpractice in Nevada could be punished in Colorado.Even though the Nevada Board of Medical Examiners made its decision on Friday, the Colorado Board of Medical Examiners will wait until mid-July to decide if any action needs to be taken in Colorado.On Friday, the Nevada medical board found Dr. Paul Cutarelli guilty of medical malpractice for "failure to use the reasonable care, skill, or knowledge" with more than one patient at the now-closed Valley Eye Center in Las Vegas.
According to Douglas Cooper, the executive director of the Nevada Board of Medical Examiners, Cutarelli's Nevada license was not suspended. The board did render the following sentence: $30,000 in fines and costs 100 hours of community service Be supervised for 30 days if he practices in Nevada again
7NEWS alerted the Department of Regulatory Agencies in Colorado and the state medical board about Cutarelli's Nevada punishment. Normally, the state wouldn't find out for at least 30 days. According to DORA spokesman Chris Lines, the state medical board won't consider any Colorado punishment until the findings are officially public, which can take up to one month.Colorado could punish Cutarelli because of the medical malpractice in Nevada, even though the complaints had nothing to do with his Colorado offices.

According to Cooper, the Nevada medical board has 30 days to file its findings of fact. When that's complete, the information is sent to the Federation of State Medical Boards and the National Practitioner Database. The Federation of State Medical Boards sends out a disciplinary alert report to state medical boards, indicating a list of doctors and disciplinary actions.Lines indicated that Nevada has until July 10th to make the findings officially public.7NEWS wanted to know why the state would wait until July to consider punishment, when it already knows some of the information."The staff of the Colorado (Board of Medical Examiners) has been in conference with people in Nevada this morning, and were advised by the Nevada Board staff that there is no public information regarding the action taken against Dr. Cutarelli in Nevada," wrote Lines. "The staff of the Nevada Board did confirm that Dr. Cutarelli did not lose his Nevada license as a result of the action about which you are inquiring. The Nevada Board will provide Colorado with the documents when they become public, but Dr. Cutarelli still has his Nevada license. Nevada indicated that they have until July 10th to report the action against Dr. Cutarelli, which would be the customary way that another licensing board would learn of an action in another state."7NEWS was unsuccessful trying to contact Cutarelli at his Englewood office.A person waiting in the lobby, who said she was going to Cutarelli for a consultation, told us she didn't know about his punishment in Nevada. The potential patient told us she hoped the staff would inform patients of the disciplinary action.
