The suspect who is accused of taking a 2-week-old infant and sparking a statewide amber alert was charged Tuesday with one count of second-degree kidnapping, a spokeswoman with the Denver district attorney said.

Darlene Rueda Banuelos, 30, will be in court for her second advisement on Thursday, around 9 a.m.

In the meantime, she has been place on suicide watch after attempting to hang herself twice while in police custody. She was not hurt in either incident. She is being held at the Denver county jail on $100,000 bond.

Her family told 7NEWS that this has all been a misunderstanding -- that the mother of five could not have intentionally taken the baby boy. They said that Rueda Banuelos was just watching the infant, as a favor for his mother, Maria Soria Hernandez, 22. They said Rueda Banuelos gave Soria Hernandez $500 to help her get on her feet and promised to watch the infant in the meantime.

Soria-Hernandez said that was not the case, and that Rueda Banuelos is a liar. She said that in one moment she was getting a drink for a woman who had befriended her, and the next minute her baby and the woman she knew only as "Rosa" were gone.

The infant, Mauro Ramirez-Soria, appears to be doing well now that he's back in his mother's arms.

Police found him a day after the amber alert was issued. He was found sleeping inside Rueda Banuelos' sister-in-law's house on 9th and Bryant.

According to the police affidavit, the suspect's teenage daughter tipped police to the baby's whereabouts after she saw news reports about the amber alert and the alleged abduction. The teen told detectives she became suspicious when her mother came home and told her to babysit.
