DENVER -- In a 13-0 vote, members of Denver City Council approved an ordinance that defines where and when medical marijuana dispensaries can operate.Monday night's move came after a lengthy public hearing where as many as 92 people signed up to speak.Several speakers, including some Denver parents, urged the council to vote for increased regulation, saying they did not want marijuana dispensaries near their homes or neighborhood schools.
Christy Gosch of the Stapleton neighborhood told the council she was worried that the number of dispensaries and proposed dispensaries in Denver outnumber Starbuck's coffee shops."Are we to believe dispensaries are meant to serve more people than buy coffee everyday?" she asked. The rules are slated to go into effect on March 1.Among the provisions:New clinics can not be established within 1000 feet of a school or day care center.Consumption on-site will be prohibitedCultivation and processing is allowed on-siteAnyone convicted or serving a felony sentence within the last five years cannot hold a license."This is a very hard issue; this is the first time we've ever had to deal with this," said Councilman Paul Lopez. "It's not going to be perfect. We're going to work on this in the years to come."Expect to see several legal challenges soon. Those opposed to the regulations take issue with the restrictions, saying they are constitutionally unsound.
