Ban On Texting While Driving Takes Effect Tuesday

Infraction Is A Primary Offense

It will soon be illegal for drivers in Colorado to text, e-mail or tweet when they're behind the wheel.

The ban passed by the Legislature will take effect Tuesday. The new law will also bar drivers under 18 from using a mobile phone for any pupose, whether hands-free or not.

The law that passed is weaker than one originally proposed at the Capitol. It would have also barred adult drivers from talking on cell phones unless they used a handsfree device.

Under the new law, texting while driving is a primary offense. An earlier news release from the House Majority office said the new law was a secondary offense.

"It is inherently dangerous to multitask while you drive. This bill is aimed at the most dangerous distraction commonly engaged in: text messaging and e-mailing while driving. If this new law prevents just one more senseless death or injury, House Bill 1094 will have done its job," said bill co-sponsor (D) Rep. Claire Levy.

Drivers could be fined $50 for texting while they drive and repeat offenders could be fined $100.
