HOA Says City Violating Agreement Made In 1973

AURORA, Colo. -- They just might prove you can fight city hall.An Aurora neighborhood is fighting to keep their library from closing due to budget cuts.The Mission Viejo Homeowners Association met with Aurora's city attorney Tuesday.
The Mission Viejo HOA said the city promised to operate that library for 50 years.Essentially -- the neighborhood gave the city of Aurora the land and the building on the condition the city operate and maintain a library or a police station at the location for 50 years.It's only been 36 years since that promise was made and Aurora is ready to shut down Mission Viejo Library and three others due to budget cuts. "I'm really sad about it. I come to this specific library at least once a week," said one library user.The HOA is currently negotiating with the city to keep the library open.The HOA has the agreement from back in 1973, but the city said it might be invalid because it was not signed by a city manager and there is no ordinance on the books.The city has, however, recognized the library's importance. The city and the HOA plan to meet again Dec. 9.If they can't reach an agreement by then, the HOA is threatening to sue the city. Mission Viejo library is the second busiest in the city of Aurora. It costs about $680,000 a year to operate. Some alternatives to closing it include limiting hours and staff.
