Voters Affirm Fines, Even Jail For Broomfield's Problem Property Owners

Measure To Sanction Owners With Rundown Homes, Weeds Passes By 52 Percent

Voters on Tuesday night reaffirmed a law allowing Broomfield to fine -- or even jail -- owners with rundown homes or weedy yards.

Question 1B passed with 52 percent of the vote.

Residents who wanted to repeal the "nuisance property" law, which was enacted by the City Council in September 2008, put Question 1B on the ballot, saying the decision should be left to voters.

Opponents said the ordinance was too restrictive and unfairly punishes people who can't afford to keep up their homes.

The law gives the city the authority to sanction people who violate three of the city's property codes. The codes include damaged or missing house siding, fencing with missing or broken sections, dead and overgrown landscaping and peeling paint.

One Broomfield resident, who asked to remain anonymous, said the city used the ordinance to unfairly punish him for a car in the driveway that had a flat tire. He said he would vote "no" on the ordinance.

City officials said the city was not looking to punish residents, but said the Broomfield was trying to address shoddy homes that drag down property values.

Broomfield residents had mixed reviews about the ordinance.

Megan McDonald said she liked the idea behind it but didn't like the harsh penalties surrounding property cleanup.
