COLORADO SPRINGS, Colo. -- No charges will be filed in the 2008 shooting death of an Aurora man at a national forest shooting range.Prosecutors with the 4th Judicial District Attorney's Office in Colorado Springs said there was insufficient evidence to file charges because it was determined that the gun that killed Otis Freison Jr. was defective.Freison was shot by Timothy Curtis on July 18, 2008 as the two were at the unsupervised South Rampart Range Shooting Range northwest of Colorado Springs. The shooting prompted the U.S. Forest Service to close the range in the Pike National Forest.
Curtis said he was carrying a Smith & Wesson SW9VE semiautomatic pistol when he dropped the slide on the pistol and it discharged, striking Freison in the chest.A forensic firearms expert examined the pistol and concluded there was a defect with the handgun and dropping the slide could cause it to fire. The popular shooting range opened in 1990 and was used by 40,000 people, according to the U.S.F.S.
