DENVER -- A judge sentenced a 38-year-old woman to 45 days in jail for setting her dog on fire, authorities said Thursday.Tanya Marie Martin was arrested in October 2008 after a neighbor saw smoke coming from her apartment, heard the dog crying, and "saw it on fire," said Pam Russell of the First Judicial District Attorney's Office.Prosecutors said Martin put the 6-year-old Yorkshire terrier named Bobo on top of a burning telephone book on a lighted stove. The dog suffered second- and third-degree burns to 50 percent of his body and died from his injuries a few days later.
Lakewood police arrested Martin and charged her with felony aggravated animal cruelty.Initially Martin pleaded not guilty by reason of insanity. Following a mental health evaluation, doctors determined she was insane when she set the fire, Russell said.On April 22, Martin withdrew her plea and pleaded guilty to the animal cruelty felony.Martin will serve 10 years probation in addition to the jail sentence. She will not be allowed to care for any animal and will be monitored to make sure she takes medication for her mental illness, Russell said."This is a tragic criminal act that has its roots in mental illness," said District Attorney Scott Storey, "Martin has a history of mental illness dating back to her teens. She had no prior criminal history, but her failure to take her medication as prescribed had disastrous consequences in this case. We take cruelty against animals seriously and a felony conviction was appropriate considering the circumstances."
