Senate Eliminates Gun Background Check Requirement
Opponents Say Bill Is Not Well Thought Out

DENVER -- Sen. Greg Brophy, R-Dist. 1, said he was shocked HB 1180 passed out of the Democrat controlled House and Senate."I got 19 democrats in the senate and house combined to vote for this bill," said Brophy.HB 1180 eliminates additional background checks for Colorado concealed weapon permit holders looking to purchase a gun.
"The waiting period for so called 'instant background checks', in some weekends, can take as long as 48 hours, effectively killing the sale of the weapon to a law abiding citizen who would have otherwise qualified," said Brophy.Sen. Evie Hudak, D-Dist. 19, said the bill is a mistake and was not well thought out.She said a CCW is valid for five years and is concerned local sheriff's won't report a person's violent arrest or restraining order after the permit is issued."I think it's worth waiting a few hours to make sure a person that gets a gun is someone we want to be able to have a gun," said Hudak.Brophy said if a person has a CCW there is a good chance they already have a gun and points out background checks are still necessary for those who don't have a CCW.The one thing both senators agree on is a component of the bill that would make CCW's uniform and tamper-proof throughout the state. The bill gives the CBI until October to come up with the identification.No word as to whether Gov. Bill Ritter plans to approve or veto the bill. Ritter has 30 days to make a decision.
