Girl Was Listed As A Witness Before Her Death

Court records show that a 13-year-old girl found dead in Broomfield was listed as a witness in a case against the teen suspected of killing her.

Kelsey Shannon disappeared Oct. 14, and her body was found about a half-mile from her home Jan. 21.

Eighteen-year-old Alexander Pacheco was being held without bond Saturday and faces charges of first-degree murder, abuse of a corpse, and child abuse resulting in death.

Court records show Pacheco was charged with theft by receiving after a teen reported his bike stolen in September and that Kelsey was a prosecution witness in the case.

According to an affidavit, the charge alleged Pacheco was seen on a bike that was reported stolen. The bike belonged to a boy whose father told police he exchanged text messages with Shannon, who led police to Pacheco.

When officers confronted Pacheco, the father of the theft victim identified several parts of the bike as belonging to his son, the affidavit said.

Pacheco pleaded not guilty Oct. 22, eight days after Kelsey disappeared.

During a hearing on Friday, the judge granted a request by prosecutors that Pacheco give blood, hair and saliva samples to aid investigators.

Pacheco did not show much emotion in court Friday but his family is shocked by the allegations.

"A lot of the evidence hasn't even been pulled yet so it's hard to decide. But we just pray that it comes out and we'll deal with it as it does. But he was raised a good boy. He still is a good boy," said Peggy Vigliotti, a member of the Pacheco family.

Broomfield District Court Judge John Popovich called the crime something that would "outrage any normal family sensibilities."

Investigators are not saying what they think happened, but according to information revealed in Friday's hearing, two homes have been searched and evidence removed.

Pacheco was arrested at his mother's house but lives with his father in Broomfield, near Kelsey's home. No cars were searched and no ballistics tests were required, implying that a gun was not the murder weapon.

"I don't think that's an issue in this case," the prosecutor said.

Arrest and search warrant affidavits remain sealed at the request of prosecutors and Pacheco's public defender. The issue will be revisited on Feb. 14 when prosecutors and defense attorneys argue that the documents remain sealed and media attornies argue to the right of information.

Pacheco is being held without bond at the Broomfield jail until his next court appearance on April 22.

The process of seeking justice for Kelsey is just beginning for Kelsey's family.

"It's been a long process. She went missing Oct. 14, so it's just been a long process ... This is somewhat conclusion. At least they have some answers," said Shannon family spokesman Matt Humphrey.

However, since the family still don't know what happened listening to the hearing was tough.

"I'm an attorney. So you have the presumption of innocence and I do some of this work so you do have to keep that in mind. But yeah, it was hard because you don't want to make any judgments but, it's difficult," Humphrey said.

"Just be fair to him in what's reported because nobody knows and, you know, they cared for each other. Kelsey and he liked each other. The were close. They liked each other," Vigliotti.
