DENVER -- Cell phones and computers will not be banned during Alex Midyette’s child abuse trial, a Boulder district judge ruled Monday.Lawyers on both sides of the case had asked to ban real-time blogging or texting of testimony inside the courtroom saying they could prejudice prospective witnesses to know what other witnesses are saying.Judge Lael Montgomery said the court order to witnesses to refrain from talking about their testimony would be sufficient, reported the Boulder Daily Camera.
"I think there are other manageable options and less restrictive options than shutting down the flow of information during the trial," she said.Midyette goes on trial next week. He is accused of causing the death of his 11-week old son, Jason, in 2006.He wife has already been convicted of failing to stop the child abuse that killed her son. She is scheduled to testify in Midyette’s trial.
