Midyette Child-Abuse Trial Coming To Denver

Trial Had Been Moved From Boulder To Jefferson County

The child abuse trial of Alex Midyette -- the Lafayette father accused in the death of his 11-week-old son -- will be held in Denver in January.

The trial was moved from Boulder to Jefferson County last June because of pre-trial publicity and has now been moved to Denver, because of difficulty setting a court date. Jefferson County could not accommodate the lengthy trial on its January docket, according to the newspaper.

The four-week trial is set to begin on Jan. 12, 2009. It was supposed to have started last week.

Midyette's wife, Molly, was convicted last December of child abuse resulting in death and is serving a 16-year-sentence in the same case.

Jason Midyette died in March 2006. The infant was brought to the hospital with multiple broken bones and a fractured skull.

Defense attorneys claim that believe Jason died from Menkes disease, an extremely rare and often fatal condition that largely affects male infants and results in floppy muscle tone, seizures, kinky hair and weakened bones, according to the Daily Camera.
