Gag Order Issued In Bonifacio Lobato Case

SAN LUIS, Colo. -- Prosecutors have filed a second-degree murder charge against a San Luis man accused of shooting his son to death. Bonifacio Lobato appeared in Costilla County Court in San Luis on Monday. Judge Kimberly L. Wood set bail at $200,000 and issued a gag order preventing attorneys, law-enforcement officers and others from discussing the case publicly. The 40-year-old Lobato is accused in the Sept. 23 death of his 20-year-old son, Dominic L. Lobato. Authorities have said the two were arguing over money.
Wood quashed defense attorney Alonzo Payne's subpoena for Eric Mullens, a reporter for the Alamosa-based Valley Courier, who had written stories about Lobato. Payne said he wanted to ask Mullens about the stories, but Payne didn't object when the newspaper's attorney asked to have the subpoena quashed.At Payne's request, Wood issued a "gag" order, prohibiting anyone official from talking to the media about the case.
