GREELEY, Colo. -- A man accused of beating a transgendered victim to death after he learned that the "woman" he was having sex with actually had a penis told his girlfriend in a phone call that he had "snapped" and that "gay things need to die," according to the Greeley Tribune.Allen Ray Andrade, 31, is charged with first-degree murder after deliberation, bias-motivated crime, felony motor vehicle theft and felony identity theft in the death of 18-year-old Angie Zapata.A Weld County district judge ruled Thursday at the preliminary hearing that there is enough evidence against him to proceed with a trial.
According to the newspaper, Zapata called his girlfriend while in jail and said he was out of control and out of his mind.The calls were laced with derogatory remarks about homosexuals, and when Andrade's girlfriend said that her cell phone was dying, he said that was "gay" and "gay things need to die," the Greeley Tribune reported.The newspaper didn't explain when the phone calls took place or how it learned of the contents of the calls.Zapata's sister found the victim's bloodied, battered body in her Greeley apartment on July 17.Zapata was born as a male, named Justin, but was living as a woman.Andrade told investigators that he met Zapata through MocoSpace, a social networking Web site, and that they agreed to get together after exchanging contact over several days, according to an arrest affidavit released by Greeley police. The two met July 15 and spent the day together.Andrade told investigators that Zapata performed oral sex on him but wouldn't let him touch her, according to the affidavit. He said he also spent the night at Zapata's apartment, but in separate beds. The next day, Zapata left Andrade alone in her apartment, and Andrade noticed several photographs that led him to question Zapata's gender, investigators said.Andrade confronted Zapata when she got back. Zapata answered: "I am all woman."He grabbed Zapata's crotch area, felt male genitalia and became angry, the affidavit states. He took a fire extinguisher off a shelf and struck Zapata twice in the head, telling investigators he thought he "killed it."Andrade told investigators he covered Zapata with a blanket and started gathering evidence he thought might link him to the crime when he heard gurgling sounds and noticed Zapata was sitting up. That's when he beat her again and again with his fists, prosecutors said.An autopsy found Zapata died from blunt-force trauma.Prosecutors said he then took off in Zapata's 2003 PT Cruiser and was arrested on July 30 at his home in Thornton.Andrade is being held at Weld County Jail without bond. He's due back in court Nov. 16. The motor vehicle theft and felony identity theft charges allege that he stole Zapata's car and debit card.A bias-motivated crime is a crime committed based on a person's race, religion or sexual orientation.Andrade faces life in prison without parole if convicted of first-degree murder.
