POSTED: 2:22 pm MDT September 15, 2008
LITTLETON, Colo. -- Arapahoe County District Attorney Carole Chambers filed nine more charges against an illegal immigrant accused of causing a traffic accident that killed three people, including a 3-year-old boy, on Sept. 4.Francis Hernandez was originally held on nine charges, including vehicular homicide and leaving the scene of an accident. He is accused of crashing into a pickup truck in on Havana Street in Aurora, Colo., killing Debbie Serecky, 51, of Aurora, and Patricia Guntharp, 49, of Centennial. The impact knocked the pickup truck they were in into an electrical switching box that struck a Baskin-Robbins ice cream shop, killing Marten Kudlis, 3. Kudlis was inside the shop with his family when he was hit and killed.
According to an affidavit, Hernandez ran to nearby Hooters after the crash.Hernandez, 23, who was born in Guatemala and entered the United States illegally in 1991, had been arrested almost 20 times in the last five years and had nine misdemeanor convictions, according to the district attorney's office. He is accused of driving under restraint at the time of the crash. The nine additional charges filed Monday included a felony count of child abuse resulting in death and eight misdemeanor counts that included leaving the scene of an accident and third-degree assault."The basis for this motion to add nine additional counts is that the facts of this case warrant the filing of these additional charges," Chambers said. "As in all cases, we are working to seek justice for all of the victims, their families and the community."Hernandez is due back in court on Nov. 10.
