WESTMINSTER, Colo. -- A 17-year-old boy accused of stabbing his friend's father during a sleepover earlier this week was charged Thursday as an adult.Andrew Michael Galek appeared in court Thursday morning and learned that he was being charged with first-degree murder.The stabbing occurred Sunday in Westminster as Galek was spending the night with a friend, a teen he had known since elementary school.
In the middle of the night, Galek grabbed a knife, walked upstairs and stabbed his friend's 63-year-old father as he was sleeping in bed, said Adams/Broomfield District Attorney Don Quick.Hans Joachim Botho Winter died at the hospital. Winter's wife, who was sleeping in bed next to him, told police that she awoke at about 1:30 a.m. to see Galek fleeing the home with a knife. He was caught about 15 minutes later, four blocks from the victim's home. A K-9 officer found him hiding under a Ford Ranger parked by Caroll Butts Park.According to the police report, Beverly Winter, the victim's wife, had called earlier that night to say that her son's friend was suicidal. She said Galek was upset with his parents and had grabbed a paring knife from the kitchen and fled to the back yard.When police tried to interview the victim's son, they said he appeared to be under the influence of alcohol as well. When investigators tried to get a statement, he was "incoherent," according to a police report.The victim's wife told police "... she was awoken when she heard her husband yell, 'Andy, why did you hit me? ... she then saw Andy standing next to the bed where Mr. Winter was lying."In the arrest affidavit, an officer reported, "Hans was lying on a bed on his back and his skin appeared to be pale. Hans appeared to have a stab wound in his lower left stomach area. Hans could not speak but was breathing."The victim's wife "... followed him (Andy) into the basement where Andy laid on the bed and began crying and kicking the wall."Then her son said they had been drinking and told her "everything would be OK," gave her a hug and then passed out on the bed, according to the arrest affidavit."Andy pulled out what appeared to be a paring knife and held it at his side, telling her 'Don't worry; I'm not going to hurt you,'" according to the affidavit.The officer who interviewed Andrew Galek stated, "I asked Galek how much he had to drink tonight and he said 7 shots. I asked what kind of shots and he said, 'Tequila.'"The victim had recently suffered a stroke and was partially paralyzed, neighbors said.Galek and his friend both attended Ranum High School. The victim's son was at home, but was not involved and did not witness the stabbing, police said.Galek remains in custody without bond. His next court appearance is scheduled for Aug. 1.
