DA Says Frease Had Consensual Relationship With Teen

EAGLE, Colo. -- A convicted sex offender is being ordered to spend two years in prison for violating terms of his probation and appearing drunk in court.A judge handed down the sentence Wednesday to 28-year-old Zachariah T. Frease. He had been sentenced to sex offender probation in September after authorities said he had a consensual sexual relationship with a 14-year-old girl.Authorities later complained Frease violated probation by drinking alcohol.
Frease was ordered to appear in court June 4. He showed up drunk, Eagle County District Attorney Mark Hurlbert said.Hurlbert said if Frease had successfully completed probation, a felony charge of attempted sexual assault on a person 15 years of age would have been dropped, leaving a misdemeanor charge of unlawful sexual contact.A person can be charged with sexual assault if the victim is less than 15 years old, and the suspect is at least four years older than the victim and is not the spouse, according to Colorado law.Last September, a woman saw Frease and the girl naked in bed through a window of a home and called the girl's parents and the police, according to a police report obtained by the Vail Daily.Frease then woke up to the girl's father beating him. The girl said she and Frease had consensual sex and that she was not threatened, forced or coerced, according to the paper.The girl's father was ticketed for misdemeanor assault.
