4th Colorado Casino Allowing Smoking
Smoking Ban Enacted Jan. 1
An anti-smoking group released a statement Tuesday that said a fourth Colorado casino "is illegally allowing indoor smoking."The state wide smoking ban was expanded Jan. 1 to include Colorado's casinos. The law has a loophole that allows smoking at cigar bars. To get that exemption, a bar must earn at least 5 percent of its annual gross income or $50,000 annually from the sale of tobacco products.The Wild Card Casino in Black Hawk did not ban smoking inside saying it sold enough tobacco products to be classified as a cigar bar.
Last week, a second Colorado casino followed that lead. Bronco Billy's in Cripple Creek claimed it too was exempt from the statewide smoking ban because of its tobacco sales.The Colorado Springs newspaper reported the Bronco Billy's smoking section occupies about 25 percent of the floor space.Stephanie Steinberg of Smoke-Free Gaming of Colorado scoffed at the claim, saying Bronco Billy's had always operated as a casino never as a cigar bar.Tuesday, Steinberg told 7NEWS, two more Cripple Creek casinos have started allowing smoking, the Midnight Rose and Double Eagle.An employee answering the phone at the Double Eagle told 7NEWS the smoking section is on the lower level of the casino, the upper level and gold creek section are both smoke free.Casino revenue has been down every month this year. Casinos admit it may be because of the economy, but they also blame the smoking ban.
