Prosecutor in Midyette Case Agrees with Motion to Move Trial

Boulder -- Prosecutors in Boulder agree with lawyers for a man seeking to move his child abuse trial out of town.Alex Midyette is charged with fatal child abuse in the death of his infant son in 2006. His attorneys say it's unlikely that they'll find an impartial jury in Boulder due to extensive media coverage of the case. In a court filing Friday, Chief Deputy District Attorney Ken Kupfner agreed but wrote that Midyette could still receive a fair trial in the Denver area.Kupfner says his primary concern is to prevent more delays in Midyette's trial, set for October.
A judge will consider the request at a hearing set for June 16th. Midyette's wife has been sentenced to 16 years in prison in the case.
