No New Trial For Mother Convicted In Infant's Death

BOULDER COUNTY, Colo. -- A Louisville mother whose 10-week-old son died after being taken to a hospital with 30 broken bones has lost her bid to have her conviction overturned and get a new trial. Twenty-nine-year-old Molly Midyette asked for a new trial on the grounds that her husband and his family bullied her, trying to keep her from testifying about his alleged role in the boy's 2006 death. In a ruling released Monday, District Judge Lael Montgomery said Midyette did not make a convincing case that there were "sufficient grounds in law or fact" for the verdict to be thrown out.
A jury convicted her in December on a charge of child abuse resulting in death. She faces sentencing Thursday. Her husband, 28-year-old Alex Midyette, is set to stand trial later this year.
