DENVER -- The lesbian couple who challenged Colorado's marriage law was expected to go on trial Monday but their trial was postponed for next month. In September, Kate Burns and Sheila Schroeder were charged with trespassing after staging a sit-in at the Denver Clerk and Recorder's Office. This was after they were denied a marriage license. They were arrested after they refused to leave. They have pleaded not guilty to a charge of trespassing.
The couple's attorney said the case is not just a trespassing case, but a case about equal rights."Why? Because I love Kate ... because there is no justice for people like us who want to get married and we stand up for those people and they support us," said Schroeder.Their trial was rescheduled for May 6.Burns said they're also asking people to recognize their right to practice their religion, which recognizes their union as a marriage. Several people showed up to the courtroom Monday, wearing rainbow-colored arm bands in support of the couple."I think this is a historic day because it's a day where we're standing up for their rights, and asking to participate in power," said John Ferguson, with the Parents and Friends of Lesbians and Gays. The couple contend they should be entitled to all the federal benefits of a heterosexual married couple.Colorado voters have passed a ballot proposal banning gay marriage. They also rejected a proposal to give same-sex couples some of the same legal benefits as married spouses.
