Fort Carson Soldier Alleges Shooting At Iraqi Civilians

Case May Never Be Prosecuted

A Fort Carson soldier alleges another solder fired at Iraqi civilians while on patrol in Iraq.

According to an arrest affidavit, Bruce Bastien told police that while he was on patrol with Kenny Eastridge in Baghdad, “Mr. Eastridge would shoot at Iraqi civilians who happened to be along the street.” He said, “an Iraqi civilian was struck on at least one occasion.”

Bastien explained to police that they used “stolen AK-47’s” when they would do these shootings because the sound of an AK-47 is very distinctive.

Bastien said “if there were any questions when the shooting was heard, they would claim they were taking on hostile fire.”

Bastien, Eastridge and another former soldier Louis Bressler are all behind bars in the El Paso County Criminal Center in Colorado Springs on charges of first degree murder for the deaths of two Fort Carson soldiers.

It was during the investigation into those murders that police learned of the possible war crimes.

Fort Carson officials said “we take these allegations very seriously and they will be thoroughly investigated.”

But former lead military prosecutor for Fort Carson, Richard Travis said prosecution would be difficult.

“It’s close to impossible,” he said. “In the sense of trying to find an Iraqi civilian and how many months ago was that incident.” “Without a victim there is very little to prosecute.”

Travis also said that if the soldier and former soldiers are convicted for the murders in Colorado Springs and sentenced to life in prison without parole, the military may not even investigate the war crimes because of a lack of resources.

“From a prosecutorial standpoint, if I had a lot of cases,” said Travis. “And I’ve got a case in Iraq and I don’t have a victim, I have to comb the hospitals. I don’t even know where to start.” “But these guys are going to be convicted and sent away for life, but I’ve got another murder case I need to work on or I have another assault here or another war crime, then I may focus on the other cases.”
